General Terms and Conditions of Sale
In accordance with the provisions of Articles L221-5, R.111-1, and L.211-1 of the Consumer Code, these General Terms and Conditions of Sale are available at any time and are systematically brought to the attention of each customer/user to enable them to place an order. Thus, placing an order and checking the box “I accept the general terms and conditions of sale” during the payment process implies the customer’s full and unconditional acceptance of these general terms and conditions of sale.
ARTICLE 1 – CONCEPT
1.1 GRU BAR & LIVE ESCAPE GAME is a concept of large-scale escape games and immersive theater owned by the company ESCAPE AND BAR BORDEAUX SARL. These General Terms and Conditions of Sale apply to any contract for the provision of a game room entered into between (1) any company of the ESCAPE AND BAR BORDEAUX SARL group and (2) the players of the room, hereafter referred to as “PLAYERS”; whether they have personally reserved or are part of the team of the person who made the reservation, hereafter referred to as “THE BUYER.”
1.2 These terms apply regardless of the booking method, whether made via the ESCAPE AND BAR BORDEAUX SARL website, hereafter referred to as “THE WEBSITE,” or with the staff of Escape & Bar Bordeaux SARL.
1.3 The gaming space made available to the players is referred to as “ROOM,” and the provision contract is referred to as “CONTRACT.” The game session for which THE BUYER reserves and pays on THE WEBSITE is called “GAME SESSION.”
1.4 ESCAPE AND BAR BORDEAUX SARL reserves the right to modify or have modified all or part of these General Terms and Conditions of Sale as well as the content of its WEBSITE (http://www.gru-escape.com) at its sole discretion, at any time, and without notice.
1.5 The General Terms and Conditions of Sale of ESCAPE AND BAR BORDEAUX SARL are available on THE WEBSITE and can be freely consulted upon request from the reception staff of Escape & Bar Bordeaux SARL.
ARTICLE 2 – PROVISION AND USE OF THE ROOM
2.1 According to the principle of the game, Escape & Bar Bordeaux SARL grants the PLAYERS the right to occupy the ROOM for a maximum duration of 80 (eighty) minutes. The occupation of the ROOM is solely for the purpose of participating in a game organized by ESCAPE AND BAR BORDEAUX SARL, which must be played in teams of 2 to a maximum of 8 people.
2.2 The PLAYERS agree that their presence in the ROOM is limited to a maximum of 80 minutes, regardless of whether they find all the clues and solve all the puzzles or not. This is inherent to the game principle. At the same time, the PLAYERS accept that the game may end before the full 80 minutes, especially if they have found all the clues and solved all the puzzles in less than 80 minutes; this will not entitle them to any adjustment or compensation.
2.3 Admission to the ROOM is only possible upon presentation of the reservation confirmation email (sent shortly after the payment process to THE BUYER) and a valid ID of THE BUYER.
2.4 Due to the complexity of the game, PLAYERS under the age of 16 are not permitted to participate. Minor PLAYERS under the age of 16 must be accompanied by at least one adult. Minor PLAYERS over the age of 16 are not required to be accompanied by an adult. In case of doubt regarding a PLAYER’s age, ESCAPE AND BAR BORDEAUX SARL reserves the right to request proof of identity.
2.5 PLAYERS are required to maintain the ROOM and all its equipment (non-exhaustive list: decorations, furnishings, electronics, etc.) in good condition and to use it in accordance with the permitted use. Thus, the PLAYER acknowledges in the CONTRACT that any intentional damage or damage caused by unauthorized handling of the ROOM and its equipment will result in a chargeback.
2.6 Furthermore, the PLAYER is obliged to use the ROOM and its equipment in such a way that no damage is caused or risks being caused to other PLAYERS, to the premises, and to the equipment of ESCAPE AND BAR BORDEAUX SARL.
2.7 During their entire presence within the premises of Escape & Bar Bordeaux SARL, the PLAYER agrees to behave respectfully, comply with the rules, and cooperate with the staff of Escape & Bar Bordeaux SARL. In this respect, ESCAPE AND BAR BORDEAUX SARL does not tolerate any form of violence, whether verbal or physical, in the form of harassment or intimidation towards its employees, and reserves the right to refuse access to the premises to anyone whose behavior resembles the aforementioned elements. Escape & Bar Bordeaux SARL also reserves the right to deny access to anyone under the influence of alcohol or drugs, as a safety measure for the individual and those around them. For all the aforementioned conditions, the denial of access does not entitle to any compensation or refund.
2.8 Due to the nature of the game, no recording may be made in the ROOM. Thus, the use of video and/or audio recording devices (including but not limited to: mobile phones, cameras, GoPros) is strictly prohibited. PLAYERS must deposit these devices in designated bins. Any use of such devices may result in the complete cessation of the game for the entire team without any compensation or refund.
2.9 Escape & Bar Bordeaux SARL expects its PLAYERS not to disclose game details directly and/or indirectly. Any partial or total disclosure would violate the commercial interests of ESCAPE AND BAR BORDEAUX SARL.
ARTICLE 3 – RATES
3.1 The prices charged by ESCAPE AND BAR BORDEAUX SARL are indicated on THE WEBSITE (on the homepage as well as in the “Rates” tab) and are also displayed at the reception of the ESCAPE AND BAR BORDEAUX SARL premises. They are displayed in euros (€) all taxes included (TTC) and per person, for an 80-minute SESSION. The price per person is determined based on the number of participants and the time of the session. Any additional service will incur an additional charge. ESCAPE AND BAR BORDEAUX SARL reserves the right to change its prices at any time. Specific conditions may apply, particularly when the customer is a business or when the players come in groups of 2 or 8. These are freely negotiated by the parties and detailed in Article 5 of these General Terms and Conditions of Sale.
ARTICLE 4 – RESERVATION
4.1 The provision of a ROOM is subject to prior reservation and payment. This is made by THE BUYER on THE WEBSITE of ESCAPE AND BAR BORDEAUX SARL: http://www.gru-escape.com.
4.2 All reservations are made from THE WEBSITE and according to the availability displayed on it. The reservation is firm and definitive only after the receipt of the reservation confirmation email, which is sent to THE BUYER at the end of the payment process.
4.3 In certain exceptional cases, the staff of ESCAPE AND BAR BORDEAUX SARL may make the reservation on behalf of THE BUYER if the latter cannot make the reservation on THE WEBSITE. In these specific cases, THE BUYER unconditionally accepts that such a reservation incurs no liability on the part of ESCAPE AND BAR BORDEAUX SARL or its staff, who act solely as data entry operators according to the instructions given by THE BUYER. Therefore, THE BUYER waives any recourse due to misuse, infringement of confidentiality of their data, or fraudulent use of their account. Only payments by credit card and culture pass are accepted on THE WEBSITE.
4.4 If THE BUYER cannot pay the amount of the reservation by credit card or culture pass, they must present themselves at the reception of ESCAPE AND BAR BORDEAUX SARL to pay the amount in euros by credit card, culture pass, or cash.
4.5 ESCAPE AND BAR BORDEAUX SARL has entrusted the management of its payment platform to a provider specializing in securing online transactions. This provider does not retain any data concerning THE BUYER in its databases.
Article 5 – PERSONAL DATA
5.1 THE BUYER is responsible for the accuracy of the information entered on the online reservation form on THE WEBSITE. The information we collect about you may include: your name, email address, postal address, phone number, and date of birth. Information related to persons under 16 years of age must be filled out with the consent of their legal guardian.
5.2 By providing the contact details of other PLAYERS (names, phone numbers, email addresses), THE BUYER authorizes ESCAPE AND BAR BORDEAUX SARL to send information and commercial offers to them. THE BUYER and/or the PLAYER who enters their phone number on THE WEBSITE of ESCAPE AND BAR BORDEAUX SARL agree to be contacted by ESCAPE AND BAR BORDEAUX SARL by phone or SMS. THE BUYER agrees to receive information and commercial offers from ESCAPE AND BAR BORDEAUX SARL at their email address or on their mobile phone by checking the authorization box on THE WEBSITE.
5.3 We retain your personal data only as long as necessary for the purposes for which we collected it, including compliance with any legal or accounting requirements and obligations to provide accountability. Customer data is retained for the duration of the business relationship. This data may be retained for commercial prospecting purposes for a maximum of 3 years from the end of this business relationship.
5.4 ESCAPE AND BAR BORDEAUX SAR
ARTICLE 6 – RIGHT OF WITHDRAWAL
6.1 In accordance with Article 221-28 of the Consumer Code, no reservation can be canceled or refunded except in the case of a cancellation solely by ESCAPE AND BAR BORDEAUX SARL. In this case, the amount of the initial reservation will be refunded.
6.2 For gift cards and in accordance with the provisions of Article L.221-18 of the Consumer Code, in the case of distance sales, the buyer has a withdrawal period of 14 days from the receipt of the gift card. No return is required for electronic gift cards; the refund will occur within 14 days from the receipt of the withdrawal request. For purchases made on-site at ESCAPE AND BAR BORDEAUX SARL, in the case of on-site sales, the buyer has a withdrawal period of 3 days from the date of purchase, without having to provide reasons or pay penalties, except for delivery and return costs, which will remain the buyer’s responsibility in the event of a return by post. The refund will occur after verifying that the corresponding gift codes have not been used, using the same payment method as that used by the consumer for the initial transaction. 6.3 Online Reservations: In accordance with Article 121-21-8 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, other than residential accommodation, transport services for goods, car rentals, catering, or leisure activities that must be provided on a specific date or within a specified period. Therefore, no reservation can be canceled or refunded except in the case of a cancellation solely by ESCAPE AND BAR BORDEAUX SARL.
ARTICLE 7 – SAFETY
7.1 The PLAYER agrees to comply with all safety measures provided, whether contractual, displayed on-site, in an explanatory video, or given orally by the staff of ESCAPE AND BAR BORDEAUX SARL.
7.2 Smoking is strictly and formally prohibited inside the premises.
7.3 Each PLAYER agrees to read and respect the fire safety instructions, as well as the emergency exits. These are clearly marked within the ESCAPE AND BAR BORDEAUX SARL premises. It is strictly forbidden to obstruct the emergency exits, which must remain clear at all times. The PLAYER may use the emergency exits only if the situation requires evacuation of the premises (for example, in the event of a fire). Any abuse and/or improper opening of these exits by one or more PLAYER(S) will result in the costs incurred by this abuse being charged.
7.4 The USER is aware that it is absolutely forbidden to bring into the premises and the ROOM items considered to be (1) physical dangers (explosive, flammable, oxidizing, pressurized or liquefied gas, corrosive), (2) hazardous to health (toxic, corrosive to skin, irritant/sensitizing, carcinogenic/teratogenic), and (3) harmful to aquatic environments.
7.5 During the COVID-19 outbreak, a mask must be worn throughout the PLAYER’s time in the premises. However, if the PLAYERS wish, upon presentation of a valid health pass, they may play without masks.
ARTICLE 8 – PHOTOS AND CAMERAS
8.1 Photos of each team of PLAYERS may be taken before, after, or during the game session. These photos may be used by ESCAPE AND BAR BORDEAUX SARL to enrich its WEBSITE or digital ecosystem (for example, without limitation, Facebook, Twitter, Instagram, TikTok, etc.). These photos will also be sent by email to the PLAYERS within a reasonable time after the game session.
8.2 ESCAPE AND BAR BORDEAUX SARL cannot be held responsible for the use made of the photos by the PLAYERS and/or the BUYER.
8.3 Each ROOM is equipped with a video surveillance and listening system that allows the staff of ESCAPE AND BAR BORDEAUX SARL to monitor the game session and guide the PLAYERS if necessary. This system is solely for the game and does not record the PLAYERS’ game sessions unless the PLAYER requests this as part of a souvenir service offered by ESCAPE AND BAR BORDEAUX SARL (service currently under development).
ARTICLE 9 – COMPETENT COURTS
These general conditions and any contract concluded incorporating these terms and conditions are governed by French law, and all disputes are subject to the exclusive jurisdiction of the French courts.
